Our Stand On The Recent Arrest in Warri Under Nigeria Same Sex Prohibition Act

STATEMENT CONDEMNING THE RECENT ARREST IN WARRI UNDER NIGERIA’S SAME-SEX MARRIAGE PROHIBITION ACT: UPHOLDING CONSTITUTIONAL FREEDOMS INTERNATIONAL HUMAN RIGHTS, AND THE RIGHT TO EXPRESSION

We members of the International Community, NGOs, and Nigerians living in the Diaspora vehemently condemn the recent arrests of 67 individuals in Warri, who were detained under allegations of conducting and attending a purported same-sex wedding. The enforcement of Nigeria’s Same-Sex Marriage Prohibition Act raises significant concerns about the protection of constitutional freedoms, adherence to international human rights standards, and the right to freedom of expression and peaceful assembly.

Nigeria’s Constitution stands as a bulwark of equality, dignity, and fundamental rights. The arrest of individuals based on their sexual orientation challenges these constitutional principles. Every Nigerian citizen, irrespective of their sexual orientation, deserves to enjoy the right to a life of dignity and freedom from discrimination, as guaranteed by the Constitution.

Nigeria is a signatory to several international human rights treaties,

Nigeria is a signatory to several international human rights treaties, including the Universal Declaration of Human Rights. These agreements uphold the inherent dignity and equal rights of all individuals, regardless of their sexual orientation. The recent arrests starkly underscore the need for Nigeria to align its domestic laws with its international human rights obligations.

Crucially, the Constitution’s provisions on the right to freedom of expression are pivotal. Every Nigerian has the right to freely express their thoughts, ideas, and opinions, as long as this expression does not incite violence or hatred. This fundamental right allows individuals to engage in open and honest discussions about issues of societal importance, including those related to sexual orientation.

The recent incident highlights the necessity for a broader dialogue on the rights and protections afforded to the LGBTQ+ community in Nigeria. Respectful discussions are essential in building an inclusive society that respects diversity. By acknowledging the viewpoints and experiences of all citizens, Nigeria can progress towards an environment of equality and justice.

We urgently call upon the relevant authorities to handle this situation with sensitivity, respecting constitutional freedoms, international human rights standards, and the right to freedom of expression and peaceful assembly. It is essential that those arrested are granted due process, legal representation, and protection from all forms of discrimination throughout the legal proceedings.

In conclusion,

we stand unwavering against discrimination and human rights violations. We reaffirm our commitment to upholding constitutional freedoms, international human rights standards, and the right to freedom of expression and peaceful assembly. By fostering an atmosphere of inclusivity and respect, we call on the government and people of the Federal Republic of Nigeria to work towards a future where every individual, regardless of their sexual orientation, can thrive in an environment of acceptance.
